Right of withdrawal


Have you purchased a product and, as soon as you open the package, did you find that it does not match your expectations?


  • Are the dimensions of the product different than you imagined?
  • Is the color different than the one you saw in the image on the website?
  • Does the product not work as you would like to?


Honestly it happens seldom. The descriptions of our products are detailed and often supplied with instructions and technical data sheet in pdf format. Our Customer Service (via chat / phone ed. note) is also able to dissolve any doubt or perplexity of our client, before executing any order.


You have the right to withdraw from the contract, without giving any reasons, within 14 days.
The withdrawal period expires after 14 days from the day you or a third party, the one you designated other than the carrier, acquires the physical possession of the goods or acquires the physical possession of the last good in the event that we necessarily provide for the separate dispatch of goods subject to purchase with a single order. 
In order to exercise your right of withdrawal, you must inform us of your decision to terminate this contract by an express statement (such as a letter sent by e-mail) at the address support@alberogroup.com writing “RETURNED GOODS #ABC12345” as subject. To do this, you can use the type of recessed attachment form (you can download it by clicking here). 
In the event you choose this option, we will send you a confirmation of receipt of withdrawal on a durable medium (e.g. by email) without delay. 
In order to comply with the withdrawal deadline, you only need to send a notice on the exercise of the right of withdrawal before the expiry of the withdrawal period. 


Withdrawal effect


If you withdraw from this contract, you will be refunded all the payments you made to us, including delivery costs (except for the additional costs arising from your choice of delivery type other than the cheap standard delivery standard we offer ), without undue delay and in any case not later than 14 days from the day we are informed of your decision to terminate this contract. 
These refunds will be made using the same means of payment you have used for the initial transaction, unless you have otherwise agreed; in any case, it will not have to bear any cost as a consequence of such redemption.
Refund may be suspended until receipt of the goods or until the consumer demonstrates that he has returned the goods, if earlier. 
In order to exercise the right of withdrawal, the products must be returned including packing, manuals and any original accessories, under the same conditions as they were delivered.
Please return the goods or deliver them to us, without undue delay and in any case within 14 days from the day you notified us of your withdrawal from this contract. The term is respected if you return the goods before the expiration of the 14-day period

- VALUE REDUCTION: 
Only responsible for value reduction of the goods resulting from a manipulation of the goods other than the one required to establish the nature, the characteristics and functioning of the goods (Article 57 Decree Law n. 206/2005).


WITHDRAWAL EXCLUSION
The right applies to the product purchased in its entirety;

it is not possible to withdraw only a part of the product purchased (e.g. accessories, software attachments, etc ...);
the purchased item must be intact and returned in its original packaging, complete with all parts (including any documentation and accessory: manuals, cables, etc.);
the shipment, up to the receipt in our warehouse, is under the full responsibility of the Customer;
in the event of goods damage during the transport, Albero Group will notify the Customer of the event (within the business day following the receipt of the goods in the warehouses) to allow him to promptly do a complaint against the courier he chooses and to obtain the value refund of the goods (if insured); in this case, the product will be returned, at customer's expense, and at the same time canceling the withdrawal request;
Albero Group doesn’t respond in any way to any damages or theft/loss of goods returned with unsolicited shipments;
upon arrival in the warehouse, the product will be tested to assess any damage or tampering that is not caused by the transport. The right of withdrawal will be completely canceled if there aren’t at least one of the points listed above.

The right of withdrawal does not cover every buyer. The first limitation is its application only to consumers. Despite past attempts to interpret this term in an extended way, it is now well established that with this term only the natural person who acts outside of his professional activity can be identified. The Civil Code, in fact, designates it in this way: "the consumer is the natural person who acts for purposes unrelated to any business or professional activity carried out" (Article 1469 bis). In essence, companies and professionals with VAT numbers can not assert the right of withdrawal for purchases made in this capacity.

 

GOODS RETURN
The return request must be notified within 14 days of thegoods  receipt by e-mail or fax. 
In the request, which must be signed and dated by the buyer, you must indicate the details of the shipping document, the list of the returned items and the bank details on which you would like to obtain the refund.
After obtaining the consent, you must store the goods, complete with any accessories, in the original wrap. This wrap must then be packed in a safe way to protect it from any damage, writing or alterations, and must be sent at your own expenses  at the following address: Albero Group Srl – Via Napoli, 194 – Nocera Inferiore (SA) - 84014 ITALY

PROCEDURE FOR THE APPLICATION OF THE RIGHT OF WITHDRAWAL

  1. Within 14 days from the purchase, please send an e-mail to support@alberogroup.com or a fax to the following number: +39 081 957 593
  2. You will be contacted by our Customer Service for a first check on the reasons for the withdrawal request and the necessary conditions for the application itself.
  3. Send the goods that are the subject of withdrawal by tracked shipping, in compliance with the above-mentioned packaging rules, to: Albero Group Srl - Via Napoli, 194 - 84014 - Nocera Inferiore (SA) ITALY 
  4. Upon receipt, the goods will be checked by our technical office and, if successful, the customer will receive an immediate notice
  5. Upon the receipt of the delivered goods, the goods purchased will be reimbursed.

 


Albero Group Srl - in the relationship with private customers, in addition to the cases detailed in the section entitled Right of Withdrawal (above) and TECHNICAL ASSISTANCE - accepts the return of the products you have purchased for the following issues:

 MALFUNCTIONS BETWEEN 7 DAYS FROM THE PURCHASE: If the product you have purchased has obvious malfunctions (it doesn’t turn on, it is damaged, etc.), you can submit a replacement request by contacting our Customer Service. Upon the receipt of the product, we will verify that the damage is not caused by improper use and we will provide the replacement or refund (if the same item is unavailable to our suppliers). If, however, the check highlighted a damage caused by your negligence, we will refund the product by charging to you all the shipping costs.
 

WRONG ORDER HANDLING: The logistics to which Albero Group entrusts its shipments is always very careful to check the contents of the shipments, but in case you receive a product other than the one you  ordered, you can contact our Customer Service and arrange (without any disbursement from you) the return of the incorrectly sent product and the relative replacement.
 

DOA: A received product is referred to as a DOA (dead-on-arrival) when it is completely defective since its first use and therefore the defect is attributable to the product production stage. Replacements in the case of DOA vary according to the policies of the manufacturers, to which the Easy Telephone must strictly adhere. If the manufacturer provides replacement, you can contact the Customer Service and start the procedure in DOA, otherwise you will need to refer to the Authorized Service Centers of the firm itself.


WARRANTEES: 
All products marketed by Albero Group Srl are covered by the statutory guarantee (24 months after the delivery of the goods), in accordance with the Decree Law 6 September 2005, n.206. In order to benefit from the warranty, the buyer will have to keep the receipt or the delivery note that will receive together with the purchased items. The 24-month warranty in accordance with Decree Law n. 206/2005 applies to a product that has a defect of conformity, provided that it is properly used, in accordance with its intended use, the instructions given and what else is provided in the technical documentation attached. This warranty, in accordance with Decree Law n. 206/2005, is reserved only to the Consumer (a natural person who buys the goods for purposes other than his professional activity, or makes a purchase without specifying the VAT registration form). In the event of a defect in product conformity during the warranty period, and provided that  the buyer has written a complaint within 14 days from the date on which the defect has been found, Albero Group Srl shall, without charge to the buyer, at the consumer’s choise,  restore the conformity of the product by repairing/replacing or remboursing the product.


Albero Group Srl guarantees that the products are made in accordance with the technical specifications stated on the packaging, technical bulletins, instructions and user manuals. In addition, Albero Group Srl assumes no liability for damages that the buyer may suffer from improper storage, custody or use of the product and if the latter has failed to comply with the instructions provided in any form by Albero Group Srl.
